1.1 All content on this website has been provided in good faith, and is for information purposes only. While every effort has been made to ensure accuracy, ShutterStyledirect cannot be held responsible for any unintended inaccuracies, and reserves the right to change the specifications of its products without prior notice.
1. 2 Any product ordered from ShutterStyledirect is bespoke, and made-to-measure specifically for the individual customer. Because of the individual nature of its products, the company is unable to offer refunds, once the product has been placed in manufacture.
1.3 Any description on this site is made in good faith, but the company is not responsible for mistakes in description. However, it will do its best to put right any manufacturing faults in the unlikely event of such occurring.
1.4. ShutterStyledirect cannot be held responsible for any damages to, or viruses that may infect your computer equipment or other property, by reason of your use, access to, or downloading of any material from this website.
1.5 The material on this website is copyright, including the brand names of ShutterStyledirect, and its shutter types, including ‘Guardsman’, ‘Havana’, ‘Belair’, ‘Palm Beach’. These brand names and associated intellectual property are protected by UK Law. Every effort has been made to contact copyright owners of images, but should copyright have been accidentally infringed ShutterStyledirect cannot be held legally responsible, but will credit a copyright owner or remove an image if the former is not agreeable, once informed by the proved copyright owner.
1.6 ShutterStyledirect shall not be liable for any direct, incidental, consequential, indirect or punitive damages, costs, losses, or liabilities whatsoever arising from your access to, use of, or reliance on or otherwise of this website.
1.7 Please note that all prices quoted on the site are per cubic metre and only metric measurements are used. The online calculator has been designed to give an approximate quotation, and this relies on the accuracy of the measurements you in put into the system. To receive an accurate quotation, we recommend that customers take advantage of our free measurement and survey service.

Ordering

2.1 Once you have accepted our quotation and made an order, you will need to pay 50% of the cost of your order, excluding fitting. You will receive a separate quotation for fitting, should you wish to organise this yourself. The price for goods and services is stated on your quotation and order. All prices are inclusive of VAT, which will be charged at the current rate in the UK.
2.2 Where a customer has chosen to measure their own windows, and through no fault of ShutterStyledirect direct an error has been made in those measurements, the company cannot be held responsible, although will endeavour to correct errors at cost. In doing so, it does not accept liability in any way.
2.3 Your Shutters can take around ten weeks to be manufactured and delivered to the UK. We will contact you to arrange a convenient time, and once your new shutters are fitted you will need to pay the remaining 50% of their manufacturing cost, and the full cost of their fitting within seven days of installation. Failure to do so will incur action by the company.
2.4 By ordering from ShutterStyledirect you warrant us that you have the right to contract us to supply the Goods and Services at the premises you request, and will supply us with such information as we may need to fit your shutters and that you will grant us access to do so. In the unlikely event of you being unhappy with our installation of your shutters or their quality, we will expect photographic evidence to illustrate any points of disagreement. Where possible, we would ask that you raise any immediate problems with our fitter, who will endeavour to rectify them at that time.
2.5 All orders are subject to a detailed survey, which will provide you with a quotation and recommendations that could improve the effectiveness or visual appeal of your shutters.
2.6 Should your 50% deposit not be paid, i.e. where a credit/debit card payment is not cleared by dint of insufficient funds, or a cheque bouncing, then ShutterStyledirect reserves the right to request 100% payment before your order is actioned, or installation of goods takes place.
2.7 Where you do not make a payment required as part of your agreement, we reserve the right to withhold your goods and not to fit your shutters until the matter has been settled. And in extreme cases will suspend all actions, pending payment, which may result in a customer losing their 50% deposit.
2.8 Orders that remain unpaid after the completion of the services shall be subject to an interest charge of 4% a year above the Bank of England Base Rate. Interest shall accrue, on a daily basis from the due date, until the date of actual payment of the overdue amount, whether before or after judgement.
Should your final balance payment not be received, we may instruct external debt collectors to collect monies from you due under your contract. Where we instruct any debt collector, we reserve the right to charge you, in addition to the overdue amount and accrued interest, and any other remedies and rights we may have, for any charges reasonably incurred by us in instructing a debt collector.

Delivery of your shutters and supply of services

3.1 We will deliver the goods to the address stated on your order, unless informed otherwise.
3.2 You will be contacted when your bespoke shutters arrive in the UK to arrange a suitable delivery/fitting time.
3.3 Where a customer fails to meet, or agree a delivery date, full payment must be made. We are unable to agree postponement of a previously agreed date for installation until full payment has been received.
3.4 For larger orders, it may be necessary to deliver your new shutters in advance of the fitting day, but where that is the case we will inform you at the time of order, so that you have plenty of time to make suitable preparations.
3.5 If you become unable to pay your debts (or have no reasonable prospect of doing so), make an arrangement with your creditors, suffer a bankruptcy order, or breach your payment obligations then we may immediately terminate your order and suspend or cancel further delivery or supply.

Warranties for the goods and services

4.1 We will supply the product and contracted services to the best of our abilities, in accordance with your agreed quotation.
4.2 If the services supplied by us are not in accordance with your order, you should notify us in writing within seven days of your shutters installation. We will arrange with you a convenient time to visit your home or premises to examine your shutters or disputed fitting, and if they are not in accordance with your order then we will either remedy the defect in question, or re-supply the services.
4.3 While every will be made to ensure that the product supplied matches the samples that you were shown during survey, there may be minor differences in colour, tone, or grain pattern in your delivered product. In the majority of cases this is due to the nature of natural wood, the grain pattern of which is dictated by varying growth patterns – such variety is of course one of the joys of natural materials. In the case the Guardsman and Palm Beach shutters, there may be slight differences in paint batches compared to the colour swatches you were shown earlier. However, since they are bespoke and made specifically to your order there are unlikely to be any differences to the paint colour throughout your specific order. Any small difference in colour, however does not entitle you to reject the goods, or withhold or reduce payment, nor attempt to claim compensation for such variation or change.

Delay or failure to perform

5.1 ShutterStyledirect shall not be liable to you if we are prevented or delayed in performing any obligations to you if this is due to any cause beyond our reasonable control including, without limitation: delays caused by our suppliers; shipping delays; an act of God; explosion; flood; fire or accident; war or civil disturbance; strike; industrial action or stoppages of work; any form of government intervention; a third party act, or omission; failure by you to give us a correct delivery address, or notify us of any change of address.

General

6.1 Nothing in these terms and conditions is intended to limit your statutory rights under the applicable laws of the United Kingdom, for example the Sale of Goods Act 1979.
6.2 Your purchase contract with ShutterStyledirect will be governed by the laws of England and the English courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.
6.3 Risk in the Goods passes upon delivery and fitting, but title will only pass to the customer upon payment in full being made and cleared.

Notice of the right to cancel

7.1 The goods are bespoke and made-to-measure to your requirements. As such they fall into the category of Tailor-made products within the Consumer Contracts Regulations and hence you will not be able to cancel your order once made. This will not affect your legal rights as a consumer in relation to made-to-measure goods that are faulty, or not as described.
7.2 However, despite the legal situation, ShutterStyledirect will accept cancellations of orders placed, provided such cancellations are received within two calendar days from the date of order. Your cancellation must be received by email to info@shutterstyledirect.co.uk, or by writing to us .
